STF’s decision on ‘all life review’ guarantees legal certainty, says AGU

Union attorney General Jorge Messias spoke on the STF’s decision that established that INSS insured people do not need to return amounts received until April 5, 2024, due to court decisions favorable to the thesis made in the so-called “all-life revision”.

According to Messiah, the Supreme’s decision is in harmony with the AGU’s defense to ensure legal certainty in Brazil. “I praise the fact that the Court definitely decided on this matter, which caused immense apprehension to the Brazilian State for the impact it could have had on social security accounts,” said the minister.

Federal Deputy Laura Carneiro (PSD-RJ) says the decision brings relief to the people who received the money and, at least, now know they won’t have to return. “It would not be fair for people to return, because they were supported by another legal understanding. The law did not change, what changed was the understanding, so it is natural that they were not harmed,” he added.

For Senator Paulo Paim (PT-RS), the decision was “dos ills, the minor: not having to return the benefit received, as they would be more indebted than they are already today,” he explained.

However, the senator states that retirees and pensioners were harmed by the STF’s decision not to recognize the calculation of the benefit for a lifetime.

“Thousands of retirees are disappointed and impaired. The situation of retirees in our country is becoming increasingly difficult, as they are no longer contemplated with the same minimum wage adjustments. For those who retired earning a little more than one minimum wage, the trend, over the years, is salary loss,” said Senator.

Paim also said that he presented a bill to include all social security contributions in the calculation of retirement, to correct, according to him, a historical injustice and ensure a fairer benefit for millions of workers who contributed throughout their lives.
