House approves increased penalty for crime against health professionals

The House of Representatives approved, on Tuesday (27), the bill (PL) 6.749/2016, which increases the penalty for crimes of homicide committed against health professional in the exercise of the profession or as a result of it. The text now follows for Senate analysis.

The proposal typifies as heinous the crime of murder against these professionals. If the project is approved in the reviewer, the standard penalty of homicide, imprisonment of 6 to 20 years, is 12 to 30 years.

According to the rapporteur, Deputy Bruno Farias (Avante-MG), the main reason for establishing this protection is the need to ensure the physical and mental integrity of professionals, given the increase in cases of violence in the workplace. The information is from Agência Brasil.

“These situations have serious consequences, such as stress, psychological illness, removal from work and drop in productivity. In addition, lived insecurity directly compromises the quality of care provided to patients, creating a harmful cycle for both professionals and the health services enjoyment,” he said.

Heinous crimes

In addition to the murder, the project on the list of heinous crimes, very serious body injury or injury followed by death against health professionals in the exercise of the profession.

The crime of injury will be considered heinous if it reaches a spouse, partner or consanguineous relative until the third degree due to the bond.

Another point of the project doubles the penalty for the crime of illegal embarrassment, when the crime is committed against health professionals in the exercise of their duties or as a result of it.

Education Professionals

The rapporteur accepted an amendment by Deputy Lucinete Cavalcanti (PSOL-SP) to include education professionals in some cases. With this, the text increases the penalty for the crime of bodily injury committed against education professionals.

The crime of contempt is folded when committed against such professionals. In cases of threat crime committed against health and education professionals in professional practice, the project determines the increase of the penalty in one third.

“Given the growing violence against education professionals in Brazil and worldwide, it is fully justified the increase of penalties for crimes against honor and bodily injury when directed to these individuals. Such a measure will not only protect educators, but will also contribute to the valorization of education and promoting a safer and more productive school environment. Strengthening laws that protect these professionals is an essential step to ensure the dignity and respect that they deserve in their important social function.” argued the deputy.
