Zambelli’s arrest depends on the chamber’s endorse
The arrest of federal deputy Carla Zambelli (PL-SP), determined by Minister Alexandre de Moraes on Wednesday (4), will still need to be confirmed by the House of Representatives. According to the Constitution, arrests of acting parliamentarians require the endorsement of the house by absolute majority – 257 votes.
Zambelli was sentenced to 10 years in prison by the Supreme Court (STF) for invasion of systems of the National Council of Justice (CNJ) and ideological falsehood. Since late May, she has been in the United States and has been pre-tried to be decreed at the request of the Attorney General’s Office. Moraes also requested his inclusion in Interpol’s red list.

To date, the House has not yet been officially notified of the decision. Parliamentarians near the Board of Directors say that if the arrest is executed, the theme will be analyzed already in the first plenary session.

If the House does not approve the arrest for 257 votes, the order of detention is automatically revoked – a scenario that could trigger an institutional crisis between the powers. The alternative would be Zambelli’s loss of mandate before the vote, which would make the home endorsement unnecessary.
The conviction of the deputy, unanimously confirmed by the first class of the Supreme Court, provides for the revocation of the mandate after the final judgment. Based on this, PT leader Lindbergh Farias (RJ) filed a request to the Board of Directors of the House so that the loss of mandate is declared immediately by administrative order. There has been no deliberation yet on the request.
Although Zambelli has few allies inside the House and even in the PL himself, deputies claim that the case can become a “message” to the STF, amid the climate of tension between legislature and judiciary. There is a discomfort among congressmen with court decisions that reach parliamentarians and interfere with sensitive themes such as amendments and legislative prerogatives.
PL can influence
Deputies evaluate that the position of the PL, party of Zambelli and the Bolsonaro family, will be decisive for the outcome of the case. Even isolated, the deputy may end up benefiting if the acronym adopts the speech that other parliamentarians may be the next targets.
There is also a veiled fear among pockets that the episode of Zambelli open precedents who reach figures such as Eduardo Bolsonaro (PL-SP). If the party closes a position for the deputy’s defense, the assessment is that the House may reverse the arrest, albeit under strong institutional wear.
