What are the next steps of the action against Jair Bolsonaro by coup d'état

The Federal Supreme Court (STF) concluded on Tuesday (10) the interrogation phase of the eight defendants pointed out as members of the “crucial core” of the attempted coup after the presidential election of 2022. The hearings were led by Minister Alexandre de Moraes, rapporteur of the criminal action that also investigates the alleged participation of those involved in a plan to assassinate authorities.

With the end of this stage, defense and prosecution will have a deadline to request new steps. Then, the 15 -day period will open for the submission of the final allegations. After that, the process will be ready to be tried in plenary – a phase that will define whether the accused will be convicted or acquitted, as well as the penalties to be applied if there are convictions.

Jair Bolsonaro (former President of the Republic)
He denied participation in any institutional rupture plan and justified criticism of the electoral system as part of his “political rhetoric.” He even apologized to the STF and starred in moments of relaxation with Moraes, in contrast to the tone of the other defendants.

Paulo Sérgio Nogueira (former Minister of Defense)
Reinforced the moderate speech. He said he had not participated in any articulation for a blow and admitted that criticism of the polls were excessive, reiterating apology.

Mauro Cid (former Assistant of Orders and whistleblower)
It was the most incisive. He confirmed the existence of a coup plan and stated that Bolsonaro received, read and changed the so -called “scam draft.” He said that the former president suppressed excerpts involving arrest of authorities, leaving only the name of Moraes in the document.

He also pointed out that Braga Netto would have acted as a link between Bolsonaro and the camps before barracks, and that he passed on to a military resources delivered in cash in the dawn.

Alexandre Ramagem (Federal Deputy and former director of Abin)
He denied having instrumentalized Abin to monitor Supreme Ministers and said that the documents found were only “personal reflections,” not sent to Bolsonaro. He stated that the material used in the former president was not produced by the agency.

Almir Garnier (former Navy Commander)
He denied having made the Navy troops available to Bolsonaro and stated that he did not see the scammer draft. He confirmed meetings at Dawn on December 7 and 14, 2022, but stated that no practical deliberation was taken.

Augusto Heleno (former GSI minister)
He used the right to remain silent and answered only to the defense’s own questions. He denied knowledge of a possible parallel office in the event of institutional rupture, although his name appears as the potential leader of this alleged government.

Anderson Torres (former Minister of Justice)
He said he traveled to the US on January 8, 2023 with all the security protocols in force. He classified as “Google draft” the coup document found at his residence and denied authorship or intention to use it.

Walter Braga Netto (former Minister of the Civil House)
He confirmed meetings with Bolsonaro, but denied any plan involvement to reverse the electoral result. Appointed by Cid as an interlocutor with the camps, the general avoided comments on the transfer of resources mentioned by the whistleblower.

What is at stake

The complaint of the Attorney General’s Office (PGR) states that former President Jair Bolsonaro led an armed criminal organization aimed at abolishing the democratic rule of law through a military coup.

The group would have been articulated inside and outside the government to question the electoral system, inflate protests in front of barracks and prepare unconstitutional decrees with the objective of unfeasing the possession of Luiz Inácio Lula da Silva (PT).

Among the central accusations are:

  • Leadership of armed criminal organization;
  • Attempted violent abolition of the Democratic Rule of Law;
  • Coup of state;
  • Damage qualified by violence and serious threat to the heritage of the Union;
  • Deterioration of listed assets.

According to PGR, Bolsonaro encouraged scammer camps, attacked the electoral system, edited a draft decree to intervene in the judiciary and pressed military commanders to join the plan.

Now the STF enters the final stretch of the case. Based on the hearings, gathered evidence and arguments of the parties, the court ministers will decide the political and criminal destiny of the former president’s main allies and Jair Bolsonaro.
