Alexandre de Moraes is confirmed rapporteur of action from the government on IOF decree

Minister Alexandre de Moraes of the Federal Supreme Court (STF) was confirmed as rapporteur of the action in which the federal government tries to recognize the validity of the decree that increased the tax on financial operations (IOF), which was overturned by Congress.

The definition occurred because Moraes is already responsible for another process, presented last month by the PL, asking for the overthrow of the decree. For the same reason, another action, presented by PSOL to review the decision of the Congress, was passed on Monday to Moraes, after being distributed on Friday to Gilmar Mendes.

The three processes on Moraes rapporteur have different goals, but all are related to the measure of the federal government to increase the IOF.

The actions of the PL and the Attorney General of the Union (AGU) focus on the decree, but with different requests: the party wants the declaration of unconstitutionality, while the government wants the recognition of constitutionality. PSOL’s request is against the decision of parliamentarians to review the tax increase.

On Monday, when analyzing a request from Gilmar Mendes about PSOL’s process, the president of the Supreme Court, Luís Roberto Barroso, considered that there was no “total or partial coincidence of objects” in this action and that of the PL, but stated that there was an “important degree of affinity between the subjects under discussion and the founded risk of contradictory decisions”.
