STJ releases TCU’s action resumption against Deltan by daily and passages at Lava Jato
The Special Court of the Superior Court of Justice (STJ) confirmed the suspension of an injunction that prevented the process of the Federal Court of Audit (TCU) of a procedure against the former attorney of the Republic and former federal deputy Deltan Dallagnol (Novo-PR).
With the decision, the progress of the Special Accountability (ECA) that investigates the alleged improper receipt of about R $ 2.8 million in Dallagnol’s daily rates and passages during its performance in the Operation Lava Jato task force.
Dallagnol had appeal to try to interrupt the procedure. Last Wednesday, 6, the STJ Special Court rejected by majority the appeal presented by the former attorney. Estadão contacted Dallagnol’s defense and advisory, but had no return.
In August 2022, the TCU condemned Dallagnol to compensate, along with former Attorney General Rodrigo Janot and former Chief Prosecutor in Paraná João Vicente Beraldo Romão, the amount of R $ 2,831,808.17. In the decision, spending on the payment of daily rates and tickets to members of the operation were classified as “illegitimate and anti -economic”.

At the time, the ministers considered the special accounts of Janot, Deltan and Romão to pay a fine of $ 200,000 each. As the rapporteur Bruno Dantas argued, the prosecutor allowed the payment “repeated and excessive” of daily and passages to people who had no home in Curitiba.
According to Dantas, the practice made a “daily and ticket payment industry” to certain finger -chosen prosecutors, “attitude absolutely incompatible with the rules that discipline the Brazilian public service,” he said.
Dallagnol appealed to the court alleging irregularities in the procedure, especially because he was being held directly, although he was not an expenses or responsible for the administrative structure of the operation.
