Nunes Marques votes against Carla Zambelli’s conviction in case of armed chase
Minister Nunes Marques of the Federal Supreme Court (STF) voted against the conviction of federal deputy licensed Carla Zambelli (PL-SP) for illegal possession of firearm and illegal embarrassment. Even with the divergence, there is already a majority in court to impose five years in prison and decree the loss of office.
The trial was resumed on Friday (15), after the request for a view by Nunes Marques in March. He was the first to diverge from the rapporteur, Gilmar Mendes, who defended the conviction based on the October 2022 episode, when Zambelli chased journalist Luan Araújo in Sao Paulo a day before the second round of the elections.

“Upon entering a commercial establishment with the gun in hand and pointed to the victim, ordering that he lay on the ground, the defendant clearly forced him to the opposite act, restricting his freedom momentary and under serious threat,” he said.
The rapporteur accompanied the ministers Luis Roberto Barroso, Alexandre de Moraes, Cármen Lúcia, Flávio Dino and Cristiano Zanin.
Prison and extradition
The case is analyzed while Zambelli is stuck in Italy. On July 29, the deputy was arrested in Rome after an attempt to escape the arrest warrant issued by Alexandre de Moraes under another investigation, linked to the invasion of the National Council of Justice (CNJ) system.
With double citizenship, Zambelli left Brazil in May and requested political asylum from the Italian authorities. The Brazilian government has already formalized the extradition request, which will be decided by the Italian court, with no defined deadline for analysis.
