The House of Representatives should vote on Wednesday (20) the bill that establishes a regulatory framework for the protection of children and adolescents in digital environments. The text, approved by the Senate in November 2024, is considered the most comprehensive ever discussed in Congress on the subject.

The process was accelerated after the Felca influencer published a video denouncing adultization and child sexualization on social networks, which exceeded 40 million views.

Since then, the House has accumulated more than 30 related proposals and articulates the installation of a Parliamentary Inquiry Committee (CPI) to deepen the theme.

According to the president of the house, Hugo Motta (Republicans-PB), the idea is to vote the text after the general commission, which will bring together parliamentarians, experts and representatives of digital platforms.

Understand the project

Among the measures provided for in the project is the obligation of affordable parental control tools, which allow responsible for limiting content, time of use and communication between adults and minors.

Platforms will also be required to create mechanisms to verify users’ age, restrict direct contact between unknown children and adults, and quickly remove inappropriate content, even without the need for court decision.

Advertising directed to children will be limited. The text prohibits practices that exploit feelings of inferiority, incite violence or encourage harmful behaviors.

In addition, platforms should adopt more protective privacy -protected settings, restrict minors access to inadequate products and services, and implement child sexual abuse notification systems.

To reinforce the protection, the project requires that the creation of accounts by children must be linked to the profile of their legal guardians, ensuring continuous supervision. The measures also include the requirement that Big Techs act on prevention of bullying, sexual exploitation and standards of use that encourages addictions or disorders.

Transparency and accountability

Platforms with over 1 million underage users should publish semiannual reports on complaints received and adopted measures. The text also states that companies report cases of child sexual exploitation to national and international authorities.

The proposal prohibits the practice of loot boxesreward boxes in online games, associated with betting dynamics, and determines actions against content that encourages addictions, image disorders and cyberbullying.

Penalties include warning, suspension and fines of up to 10% of annual revenues or up to R $ 50 million per infraction.

The political debate

Despite the broad support in the Senate, part of the conservative bench in the House showed resistance to the text, alleging risk of censorship and excess of state regulation. Still, the voting is expected to advance with a favorable majority, given the social repercussion of the subject.
