Jair Renan Bolsonaro has a project against ‘ideological indoctrination’

The Attorney General of the Balneário Camboriú City Council (SC) considered the bill presented by Councilman Jair Renan Bolsonaro (PL) to prohibit “ideological indoctrination to communism, socialism and Nazism in the scope of school education” in the municipality.

The agency opined for the “inadmissibility” of the proposal, unconstitutional for invading the union’s competence to legislate on the guidelines and the basis of national education and violate freedom of chair, the pluralism of ideas and pedagogical autonomy, principles that must govern public education.

Sought by EstadãoJair Renan reported through his office that he will not speak on the subject at the moment.

The Attorney’s Office stressed that “although the conduct of Nazism is unlawful and not assured by the principle of freedom of expression, according to the consolidated understanding of the Supreme Court (STF) that equates Nazism to racism and hate discourse, the extension of this prohibition to communism and socialism is disproportionate and contrary to the Federal Constitution of 1988”.

The project sent for organ analysis was a substitute, filed this month. The initial proposal, filed, dated May and was the first legislative proposition of former President Jair Bolsonaro (PL) son since taking office earlier this year.

It contained the “prohibition of the display of symbols, emblems or any forms of apology or indoctrination to communism, socialism and Nazism in public and private spaces for collective use.”

The purpose, according to the text, was “to sensitize and inform the population about the historical harms of these ideologies.” It would be prohibited, for example “the display, by any means”, from the scythe and hammer crossed or intertwined. He was also considered unconstitutional by the Attorney’s Office and had a negative opinion from the Justice and Writing Commission.

In the opinion on the substitute project, the Prosecutor’s Office determines that, if the proposal is admitted, social participation is ensured through a public hearing and/or invitation to the Municipal Education Council (Conseme) to comment on the project.

In addition to this proposal, throughout the year the councilman presented 25 nominations, nine motions, three requirements, three requests for information and a second bill in July. The text prohibits hiring shows, artists and events open to children who have “expression of apology for organized crime or drug use”.
