Fed Director triggers Trump in court after attempted dismissal
Cook seeks a decision that confirms his condition as governor of the Fed, which would allow him to continue fulfilling his responsibilities.
When requesting “immediate precautionary and declaratory measures”, Cook also asks to safeguard the independence of Central Bank employees, determined by Congress.
On Monday, Trump published a letter in which he said he fired cook “with immediate effect.” He cited accusations of false statements in his mortgage contracts.
The White House said on Thursday that Trump determined that “there were reasons to dismiss a governor, who was convincingly accused of lying in financial documents, of a highly sensitive position that supervises financial institutions,” according to a statement by spokesman Kush Desai.
Cook, the first African-American woman to join the Fed Governors Board, was not accused of any offenses and the alleged incidents occurred before she assumed her current position.
Federal law states that Federal Reserve employees can only be fired by “just cause”, which could be interpreted as mismanagement or breach of duty.
