Vote of Moraes must be technical and occupy the first day of the trial

The trial of the coup plot criminal action in the first class of the Supreme Federal Court (STF) will be resumed on Tuesday (9) in the morning, when the rapporteur of the case, Minister Alexandre de Moraes, will give his vote. The procedure should extend throughout Tuesday, at least three hours long.

It is expected that, in the end, he ordered the conviction of former President Jair Bolsonaro for the imputed crimes and that the penalty may exceed 40 years in prison. Moraes must also request the conviction of the other defendants, but with variation in the penalties.

A first will deal with preliminaries, such as the jurisdiction of the Supreme Court to judge the process; Issues involving Mauro Cid’s award -winning denunciation; and access to the tests. This last point is relevant because the defenses say they did not have access to the full evidence so that they could refute them.

The second part of the vote will be dedicated to the merits, that is, to the reasons why the defendants must be convicted. At this stage, the minister must present an X-ray of everything that was collected during investigations and evidence of authorship and materiality.

There is a doubt whether the minister will already indicate the penalties during the pronouncement of the vote or at a later time.

After the rapporteur’s vote, the ministers Flávio Dino, Luiz Fux, Cármen Lúcia and Cristiano Zanin, president of the class, vote. Only later, with the five votes given, will the sentence be written, in case of conviction, both Bolsonaro and the other defendants, following the understanding of the majority.
