Câmara approves Sergio Moro project against attacks on public agents

The House of Representatives approved on Tuesday’s project by Senator Sergio Moro (União Brasil-PR) that makes the planning and order of attacks on public agents, hardens the legislation on organized crime and expands the protection network for authorities and servants acting to combat factions. The text, already approved by the Senate, now goes to presidential sanction.

The vote was not foreseen in advance and took some parliamentarians by surprise, especially governors who complained that the security PEC must be discussed.

The proposal was presented in March 2023, shortly after the Federal Police revealed a criminal faction plan to assassinate authorities, including Moro himself, former judge of Operation Lava-Jato and former Minister of Justice. The senator said he prepared the project “as a legal response to organized crime” amid the escalating threats against magistrates, prosecutors and police.

The text creates two new criminal types: the obstruction of actions against organized crime and the conspiracy to obstruct actions against organized crime. In both cases, penalties range from four to twelve years in prison, as well as a fine.

By the new rules, those who sort, promise or offer advantage for someone to practice violence or serious threat against judge, prosecutor, police, lawyer, jury, witness or expert may be punished, even if the attack does not materialize. The same goes for those who conspire with other people to commit this type of crime.

The project also states that those convicted or investigated for these conduct should start serving the penalty or provisional arrest in federal maximum security prisons in an attempt to prevent communication with criminal organizations.

Another point of the proposal expands the possibility of personal protection to retired authorities and family members of judges, promoters and police at risk. The text requires the police to evaluate the need for security measures and extends the reach of this protection to servers and military personnel acting in border areas, considered more vulnerable to factional performance.
