Administrative Reform advances in the Chamber after resistance from civil servants

Representative Pedro Paulo (PSD-RJ) filed this Friday in the Chamber of Deputies the Proposed Amendment to the Constitution (PEC) of the Administrative Reform, which aims to modernize public service careers and eliminate super salaries.

The text was presented about three weeks ago, and needed the signature of 171 of the 513 deputies to begin processing. According to the deputy — who was rapporteur of the working group that dealt with the issue in the House —, the coordination of groups of civil servants weighed on the acceptance of the project among parliamentarians.

With a drop in the signatures collected, the deputy says he had to launch the “anti-penduricalho operation”. The president of the House, Hugo Motta (Republicanos-PB), acted personally to change the leaders’ perception, stated Pedro Paulo. The proposal is treated by Motta as his great legacy as President of the Chamber.

What the PEC proposes

The text of the PEC seeks to restructure public administration and impose limits on the remuneration and benefits of employees of the three Powers — Executive, Legislative and Judiciary — at all levels of the federation (Union, states and municipalities). Among the main measures planned are:

  • Prohibits compulsory retirement as a disciplinary sanction for magistrates and members of the Public Ministry who commit serious misconduct, replacing it with the penalty of loss of position or dismissal;
  • Creation of a single remuneration table for civil servants, with the ceiling limited to the salary of a STF minister;
  • Prohibition of additional payments for length of service, bonus licenses and other advantages known as “perks”;
  • Prohibition on vacation payments exceeding 30 days per year, except for specific exceptions;
  • Mandatory performance evaluation for career progressions and productivity bonuses;
  • Greater transparency, with individual disclosure of all funds received by public servants;
  • The proposal also introduces management by results as a constitutional principle, providing performance targets and mandatory strategic planning for federal, state and municipal governments.

Professionalization

The text also deals with rules to modernize the public service, such as:

  • Require prior sizing of the workforce as a condition for new competitions;
  • Prioritize transversal careers capable of working in different bodies;
  • Rationalize remuneration structures, limiting initial remuneration to a percentage of the career ceiling;
  • Discipline commission positions with preferential selection through a selection process;
  • Link progression and bonus payments to measurable results.
  • The proposal also deals with topics such as digital transformation of the State and clear rules for governance and management.
