Moraes will be rapporteur of the action against bonuses for police officers who ‘neutralize criminals’
The action that questions the law of the State of Rio de Janeiro that established the payment of bonuses to civil police officers for “neutralization of criminals” was distributed as a precautionary measure to Minister Alexandre de Moraes, of the Federal Supreme Court (STF). Moraes’ report was a request from the Socialism and Freedom Party (PSOL) due to the fact that the minister had already reported the Allegation of Failure to Comply with Fundamental Precepts (ADPF) in the Favelas, in which the STF imposed a series of restrictions on police operations in the State.
The Direct Action of Unconstitutionality (ADI) presented by PSOL also requests a precautionary measure to suspend the effects of the law until the final judgment of the action by the plenary of the Supreme Court.

The acronym claims that there is a direct connection between the law approved by the Legislative Assembly of Rio (Alerj) and the determinations already established by the Court in the ADPF of Favelas. According to the party, the payment of bonuses for operational results could encourage an increase in police lethality and contradict constitutional parameters established by the STF itself.

The rule authorizes the payment of bonuses between 10% and 150% of the police officer’s salary, depending on the results of their performance on duty. The device was included by parliamentary amendment and was vetoed by the state governor, Cláudio Castro (PL), but the veto ended up overturned by Alerj.
In the action, the PSOL argues that the measure resumes the so-called “wild west bonus”, a model adopted in Rio in the 1990s and later revoked after criticism for encouraging armed clashes and deaths in police operations.
In addition to the merit, the party points to a formal defect in the legislative process, by maintaining that the creation of a remuneration bonus by parliament would violate the private initiative of the head of the state Executive, in addition to generating expenses without an estimated budgetary impact.
With the draw, it will now be up to Moraes to analyze the request for precautionary measure.
