Novo again sues PGR and PF against Toffoli for alleged interference in the Master case

This Monday, the 26th, the Novo Party bench filed a criminal report with the Attorney General’s Office (PGR) and a Communication of Facts to the Federal Police (PF) against Minister Dias Toffoli, of the Federal Supreme Court (STF). Parliamentarians point to atypical interference by the magistrate in conducting investigations involving Banco Master.

The representations were signed by deputy Marcel van Hattem (RS), leader of the party in the Chamber, by deputy Adriana Ventura (SP) and by senator Eduardo Girão (CE). In the documents, the group requests the investigation of possible irregularities related to the minister’s actions in the case.

With the two representations filed this Monday, Toffoli became the target of eight representations related to the case. Last week, the Attorney General of the Republic, Paulo Gonet, filed a request for the minister’s withdrawal from the Master case report also signed by parliamentarians from the Novo bench.

When contacted, Minister Dias Toffoli did not comment. The space remains open.

According to parliamentarians, when taking on the rapporteurship of the process, Toffoli would have adopted measures that would go beyond the limits of the jurisdictional function. Among the points cited, the bench mentions the minister’s decision to place the case under secrecy, transfer the investigation to the STF by monocratic decision and concentrate under its reporting acts that, according to the authors, should remain under the conduct of the PF and the Federal Public Ministry (MPF).

In the Communication of Facts sent to the PF, parliamentarians also cite decisions that, according to them, directly interfered in the dynamics of the investigation, such as the determination that seized materials be sealed and kept under the custody of the Supreme Court, in addition to the choice of PF experts to work on the case.

The document also states that there was interference in the definition of deadlines and the organization of testimonies from those under investigation, in addition to holding hearings on the premises of the STF, which, in the bench’s assessment, would have restricted the corporation’s technical autonomy.

Parliamentarians also mention journalistic reports, including from Estadão, which highlighted personal and family ties involving the minister and people related to the group being investigated, in addition to asset movements linked to ventures associated with the Toffoli family.

As Estadão revealed, pastor and businessman Fabiano Zettel, brother-in-law of banker Daniel Vorcaro, is the owner of the investment funds that bought part of the Toffoli brothers’ stake in the Tayayá resort, in the interior of Paraná.

According to the document, these elements, analyzed together, would justify an in-depth investigation by the control bodies.

In the criminal report presented to the PGR, Novo maintains that the facts could constitute, in theory, crimes such as money laundering and asset concealment, in addition to alleged interference. The bench asks the body to evaluate the opening of an investigative procedure and the possible inclusion of the minister in the investigation center.

“The Attorney General’s Office and the Federal Police need to act independently and fulfill their constitutional duty. Society demands a clear response from State institutions. This is not a case that will be swept under the carpet”, said Marcel van Hattem in a statement.

According to parliamentarians, the initiative has an institutional and not political character. They state that Congress’s actions include provoking control bodies whenever there is evidence of irregularities involving authorities of the Republic, including members of the Judiciary.

Representations against Toffoli

The conduct of the Banco Master investigation by minister Dias Toffoli has led, to date, to eight formal representations and initiatives against the magistrate in different instances, such as the PGR, the National Council of Justice (CNJ) and the Federal Senate.

Of the eight representations against Toffoli, five are requests for suspicion. While one of these requests has already been denied by the PGR, four others are awaiting an opinion from prosecutor Paulo Gonet. In addition to the arguments to remove the rapporteur of the Master case, Toffoli is the target of an impeachment request filed in the Senate.

The measures include requests for suspicion, administrative representations, crime reports and requests for impeachment, which question everything from possible conflicts of interest to decisions considered atypical from a legal point of view, in addition to the rapporteur’s personal and family connections with those investigated in the case.

Novo was the author of several initiatives related to the case. Furthermore, the party informed that it will file a request for impeachment of minister Alexandre de Moraes in the first week after the parliamentary recess, with the support of more than 100 congressmen.
