Fachin files lawsuit over Toffoli’s suspicion in Master case

The president of the Federal Supreme Court (STF), Edson Fachin, filed on Saturday (21), the action that questioned the role of minister Dias Toffoli as rapporteur of the investigations into fraud at Banco Master in the Court. The shelving of the so-called suspicion argument was due to “loss of purpose”, as Toffoli left the reporting of the case, which was redistributed to Minister André Mendonça.

With this, Toffoli will still be able to participate in a possible trial of the case, unless he declares himself a suspect in the future – prevented from participating due to having a connection with the parties or another interest in the case.

On February 12, after a tense meeting – which had the content recorded and leaked – a note signed by the ten STF ministers announced that Toffoli had decided to leave the rapporteurship of the process. This occurred one day after the Federal Police handed President Fachin a report listing mentions of Toffoli in conversations taken from the cell phone of Daniel Vorcaro, owner of Master, and also conversations between the minister and the banker.

The PF pointed out the possible existence of signs of crimes in the facts and the possibility of suspicion if Toffoli continued as rapporteur. In the note released at the time, the STF ministers, however, said “there is no reason to argue suspicion”.

Master was liquidated in November last year by the Central Bank (BC) and is being investigated for fraud worth R$12 billion.
