Fachin: we will create a technical committee on the transitional regime for “hangings”
The president of the Federal Supreme Court (STF), Edson Fachin, said that the leadership of the Three Powers committed to creating a technical committee of an advisory nature to create a transitional regime for compensation funds, the so-called “hangings” that contribute to the salaries of public servants exceeding the civil service ceiling, equivalent to the salary of a STF minister (R$ 46.3 thousand).
The deliberation took place after a meeting held on Tuesday between Fachin, the presidents of the Senate, Davi Alcolumbre (União-AP), of the Chamber of Deputies, Hugo Motta (Republicanos-PB), of the Federal Court of Auditors, Vital do Rego, the deputy attorney general of the Republic, Hindenburgo Chateaubriand, the vice-president of the STF, Alexandre de Moraes, and ministers Gilmar Mendes and Flávio Dino, rapporteurs of processes on the theme.

“In terms of decisions that we must comply with, the theme in both meetings was understanding the scenario of delay in the regulation of compensation installments that should be regulated in ordinary national law not yet enacted by Congress,” said Fachin.
“Historically, this Court has ensured the constitutional provision of the salary ceiling. The issue remains a tormenting one, given the publication of laws and normative acts that may not be compatible with the Constitution”, he added.
Dino’s decision began to be judged this Wednesday (25) by the plenary. When starting to read the report, the minister highlighted that the debate “aims at valuing and respecting public service, and not putting rights at risk”.
According to the decision, additional payments that are not provided for by law must be suspended after 60 days. Until then, the Three Powers must review all items paid as additional salaries. Dino defended that Congress regulate a law that defines which compensation funds are “really admissible as an exception to the ceiling and subceiling”.
