Argentina grants refuge to Brazilian convicted of the act of January 8

Argentina’s National Commission for Refugees (Conare) decided to grant status refugee to Brazilian Joel Borges Correa, convicted in Brazil for participating in the attacks on the headquarters of the Three Powers on January 8, 2023. The decision was taken this Tuesday (10) and announced by Folha de S. Paulo.

Correa had been sentenced by the Federal Supreme Court (STF) to 13 years and six months in prison for the coup acts in Brasília. Even so, he received protection from the Argentine government after requesting refuge in the neighboring country.

Escape attempt

The Brazilian was detained in November 2024 while trying to leave Argentina towards Chile. He was approached by the Argentine Federal Police during a traffic control in the tourist town of El Volcán, in the province of San Luis.

At the time, Correa only had a suitcase with clothes in the car. Before attempting to cross the Andes Mountains, he lived in Buenos Aires.

Fate of investigated

Some of those investigated or convicted of coup acts have sought refuge in Argentina in recent years. In requests presented to the country’s authorities, Brazilians claim to suffer political persecution in Brazil.

The analysis of these requests tends to take time and depends on the assessment of Conare in Argentina, the body responsible for deciding who can receive international protection.

The country began to attract defendants linked to the attacks after the inauguration of President Javier Milei, in 2023, who maintains political alignment with former President Jair Bolsonaro.

How refugee status works

According to Argentine Conare rules, the status Refugee status is granted to people who are outside their country because they fear persecution for reasons of race, religion, nationality, membership of a certain social group or political opinions.

The legislation also provides protection for individuals who leave their country due to threats to life or freedom caused by generalized violence, armed conflicts or serious human rights violations.

The Argentine commission responsible for analyzing these requests is made up of representatives from different government ministries and performs a similar function to the Brazilian body responsible for evaluating asylum requests.
