General stampede: Why the STF toughened measures against those convicted of the coup plot

The Minister of the Federal Supreme Court, Alexandre de Moraes, declared the final judgment and the beginning of the sentence of those convicted in core two of the coup plot. The decision was taken this Friday, the 24th, but has a reduced impact, as all five convicts were previously imprisoned.

The trial concluded on December 16, but the defenses filed appeals, which did not succeed, to try to reverse the convictions. With the final judgment, the understanding is that the process has been concluded.

Core 2 is made up of people responsible for “managing” and implementing actions to try to keep former president Jair Bolsonaro (PL) in power. They are:

  • General Mário Fernandes, former executive secretary of the General Secretariat of the Presidency, sentenced to 26 years and 6 months in an initial closed regime and a fine of 120 minimum wages; prepared the Punhal Verde e Amarelo Plan, which envisaged the assassination of President Lula (PT), vice Geraldo Alckmin (PSB), and Moraes
  • Silvinei Vasques, former director of the Federal Highway Police, sentenced to 24 years and 6 months in an initial closed regime and a fine of 120 minimum wages; made it difficult for voters to access the polls in the 2022 election
  • Colonel Marcelo Costa Câmara, Bolsonaro’s former aide-de-camp, sentenced to 21 years in an initial closed regime and a fine of 120 minimum wages;
  • Filipe Martins, former International Affairs advisor to the Presidency, sentenced to 21 years in an initial closed regime and a fine of 120 minimum wages; helped draft the coup draft
  • Marília Ferreira de Alencar, federal delegate and former director of Intelligence at the Ministry of Justice and Public Security, sentenced to 8 years and 6 months in an initial closed regime and a fine of 40 minimum wages.

Federal delegate Fernando Sousa de Oliveira was also denounced by the Attorney General’s Office as part of the group, but was acquitted by the STF. He was Director of Operations at the Ministry of Justice and Public Security during the Bolsonaro administration.

Vasques, Martins, Costa Câmara and Fernandes were already in pre-trial detention while they sought to reverse their convictions. The former director of the PRF tried to flee to Paraguay after the conviction, while Martins failed to comply with precautionary measures – he allegedly used the social network Linkedin, which he was prohibited from doing.

Marília de Alencar has been under house arrest since December last year. In this Friday’s decision, Moraes continued to serve his sentence at home, using an electronic ankle bracelet, for another 90 days.

The justification is that she underwent medical surgery in March. “The convict has been traveling to undergo consultations and post-operative exams, and there is no news in the records of non-compliance with the precautionary measures imposed,” wrote Moraes.
