Deolane shares a special 9 m² cell with a lawyer in an overcrowded prison in SP

Influencer Deolane Bezerra shares a 9 square meter cell with another lawyer at the Tupi Paulista Women’s Penitentiary, in the interior of São Paulo. Because she is also a lawyer, she is entitled to different treatment in prison. Therefore, Deolane was exempted from the initial isolation during the inclusion period, in which newly admitted prisoners are kept in a separate wing for a period of 10 to 30 days.

The influencer was arrested on Thursday, 21, during Operation Vérnix, by the Civil Police and the Public Ministry of São Paulo (MPSP), which is investigating an alleged money laundering scheme by the Primeiro Comando da Capital (PCC). She had preventive (provisional) detention authorized by the Court. The report tries to rely on Deolane’s defense.

After the arrest, in Barueri, in Greater São Paulo, the investigated woman was detained at the Santana Women’s Penitentiary, in the north of the capital, and this Friday, the 22nd, she was transferred to the interior unit, where she was admitted at 12 noon, according to the Penitentiary Administration Secretariat.

Deolane Bezerra Santos, her full name, is registered as a lawyer in the São Paulo section of the Brazilian Bar Association (OAB). According to the National Register of Lawyers, your situation is regular before the Bar.

The cell assigned to Deolane has a bunk bed, fan and shower. Being a lawyer, she has more privacy and escapes the problem of overcrowding in the penitentiary. According to SAP data, one day before the prisoner’s arrival, the unit had 873 inmates, with 159 above its capacity, which is 714.

If she needs medical, gynecological and dental care, she will be attended to by the same structure that serves other prisoners. The food served in the prison is also the same for all prisoners, including those in special cells.

The routine at the women’s prison begins at 7 am with breakfast. At 8 am the first sunbath is allowed. Afterwards, they return to their cells for lunch, served at 11 am. In the afternoon, they leave their cells at 1 pm to sunbathe again and dinner is served at 6 pm, when the prisoners return to the pavilions.

The women’s penitentiary where Deolane is located is on Rodovia João Ribeiro de Barros (SP-294), at km 667.8, in the rural area of ​​the municipality. The prison was opened in August 2011 and has a built area of ​​approximately 20 thousand m2.

Deolane’s arrival at the local penitentiary aroused curiosity in Tupi Paulista, a city of 16 thousand inhabitants, in the extreme west of the state. This Friday, the 22nd, a group of fans gathered in front of the unit in support of the influencer. Images were posted on social media.

Special cell for lawyers

In a trial held in May 2023, the Federal Supreme Court (STF) overturned the provision in the Code of Criminal Procedure that granted special imprisonment to those with higher education, until a final criminal decision. The plenary, unanimously, concluded that the benefit is unconstitutional, since it is based only on a special and supposed personal or moral quality of the prisoner.

However, the lawyers maintained the benefit, which is provided for in the Law Statute. The prerogative was also maintained for judges, ministers, prosecutors and military personnel, also benefiting, in specific cases, politicians in office. In case of final conviction, the right is cancelled.
