The Washington DC prosecutor’s office asks to denounce the National Guard in the elections and warns Trump

IN 30 SECONDS

  • What has happened? The Attorney General of Washington DC, Brian Schwalb, has asked voters to report the presence of the National Guard near polling stations during legislative elections.
  • Who is behind? The District Attorney General’s Office, Joint Force Command-DC and the Trump Administration, which Schwalb says he has contacted. In parallel, the Department of Justice deploys about 1,000 monitors in all 50 states.
  • What impact does it have? It opens an institutional pulse in the middle of election day and adds tension to an event that Madrid and Brussels follow as a thermometer of Congress that will condition tariffs and the transatlantic agenda.

The prosecutor’s office Washington D.C. asks voters to denounce the presence of the National guard at the polling stations. The District Attorney General, Brian Schwalb, assures that his office has already contacted the Trump Administration about this deployment.

The message came through social network X. Brian Schwalb is the attorney general of the District of Columbia, an elected position that serves as the city’s legal services, not as a federal prosecutor. He wrote that ‘federal law prohibits the military and federal law enforcement from interfering in elections.’

The warning has a recipient. His office, the OAG, has contacted the Administration in recent days about the presence of troops and federal agents near the voting centers. According to his story, the command of the Joint Force-DC—the group that integrates the Guard and the federal agents deployed in the capital—has ordered its members not to patrol around any voting center.

That’s the exact point of the conflict.: not the military presence in the city, but its proximity to the polls. ‘Every resident of Washington has the right to vote free of intimidation or interference,’ said Schwalb, who enabled two avenues of complaint: his own office and the District Electoral Board.

What the National Guard can and cannot do in an electoral college

It is not an impromptu warning. Last month, the office published a statement to inform voters of their rights regarding election observation, with a list of bodies that federal legislation places outside the polls: military personnel, the FBI, ICE and federal marshals. The rule is old; the pulse, however, is from this autumn.

In Washington, we don’t vote just to elect a mayor: we vote to measure how far federal deployment in the streets can go.

This Tuesday the District elects a mayor, a delegate to the House of Representatives – a non-voting seat in the chamber -, two members of the council and several seats per neighborhood. Washington has been a Democratic fiefdom for decades and the local result is not in doubt. What is being discussed is the voting framework: these are the first general elections that the capital has held since donald trump returned to the White House and activated the deployment of the National Guard, underway since August 2025 and scheduled, as announced, until the inauguration in 2029.

One thousand federal monitors in all 50 states: the other half of the operation

Outside the District, the Justice Department has deployed about 1,000 election monitors in all 50 states, the first time it covers the entire country. Comparison with the quote above gives the scale: In 2022, with Joe Biden in the White House, the department sent fewer than 400 observers to 24 states. The jump is more than double in personnel and 26 states in coverage.

The Civil Rights Division has deployed observers since the 1960s. The usual practice was limited and decided based on need; The monitors monitor compliance with the law and have more powers than the voluntary observers of the parties, but they are still just that: observers.

Washington Logic

To understand what is happening we have to start with an institutional oddity: Washington DC is not a state. It is a federal district and Congress has authority over it that it does not exercise over any other city in the country. The coalition that supports Trump has been presenting the capital as a showcase for its public order policy for yearsand that argument carries as much weight with his electorate as any employment figure. The deployment is not read by the Administration as an anomaly, but as the consequence of a federal competence that they consider poorly exercised by local authorities.

It is also not the first time that Washington has seen troops on the street. In 1932 the Army dispersed the Bonus Army veterans camped in the city; In 1968, after the assassination of Martin Luther King, federal troops returned to patrol the capital. From that discussion came the Posse Comitatus Actthe 1878 law that separates the Army from police functions and that remains the legal boundary that the prosecution now invokes. The novelty of 2026 is not the deployment: it is its coincidence with an election day.

For Spain the reading is indirect, but not minor. The composition of Congress that emerges from these legislative elections conditions the tariff agenda that Washington applies through the Section 232 —the article of the 1962 trade law that allows the president to impose tariffs for national security without going through the Capitol—: automobiles, olive oil, wine and Spanish machinery depend on that balance. The pace of defense spending demanded by NATO and the margin to close the commercial framework between Brussels and Washington also depend on it.

The unknown remains. No one knows yet if any of these complaints will end up in court or if federal monitors will find anything to challenge. The National Guard will remain in Washington, as announced, until 2029.

Case File

  • The case: The attorney general of Washington DC asks voters to report the presence of the National Guard near polling stations and affirms that his office has contacted the Trump Administration.
  • Key data: About 1,000 Justice Department monitors in all 50 states, compared to fewer than 400 in 24 states in 2022. The National Guard has been deployed in the capital since August 2025 and its mission extends until 2029.
  • For Spain: The composition of the Congress that emerges from these legislative elections conditions the tariff policy that affects Spanish exports and the calendar of the transatlantic defense and trade agenda.
