Bolsonaro’s defense resorts to the Supreme Court against house arrest
Former President Jair Bolsonaro’s defense appealed on Wednesday against the householder’s house arrest decreed on Monday by Minister Alexandre de Moraes of the Supreme Court (STF), showed a request sent to the magistrate seen by Reuters.
In the nine pages appeal, the lawyers ask Moraes to reconsider the measure in a retraction court and if this does not occur, they ask the case to be urgently submitted to the assessment of the Supreme Physical Plenary.
The defense states that there was no breach of the precautionary measures imposed on Bolsonaro. The lawyers argue that the former president’s speech does not fit “in any way” in the content considered prohibited by Moraes’s previous decision, who had prevented the former president from using, directly or indirectly, social networks.

By telephone, Bolsonaro made a speech that was transmitted by his son, Senator Flávio Bolsonaro (PL-RJ), during an act in Copacabana on Sunday when there were attacks on STF ministers and the defense of the former president, defendant for attempted coup. For defense, speech was restricted to generic greeting expressions.
“Good afternoon Copacabana, good afternoon my Brazil, a hug to all. It’s for our freedom, we are together. Thanks to all, it’s for our freedom, our future, for our Brazil. We’ll always be together! Thanks!”, Transcribed the defense.
“As it turns out, there was no reiteration of the alleged ‘characterizing statements of criminal offenses that led to the imposition of precautionary measures’, which is why there is no talk of breach of the imposed precautionary measures,” he argued.
Bolsonaro’s son, Senator Flávio Bolsonaro (PL-RJ), even published the call on a social network, and then erase it. The attitude was remembered by Moraes by determining the former president’s house arrest, considering that the senator deleted the content with the “purpose of omitting legal transgression”.
