“Call as you want, it’s a blow,” says Moraes about the draft discussed by Bolsonaro

Minister Alexandre de Moraes said on Tuesday (9) that there is no doubt that Jair Bolsonaro (PL) argued with the commanders of the Armed Forces measures to break the constitutional order after losing the 2022 elections.

During the reading of his vote in the trial of the coup plot, Moraes classified the documents seized by the Federal Police as “the draft of the coup”.

“State of site, a state of defense, outside the constitutional hypotheses, is a coup. Those who intend to give the coup, give the coup, as intended here and tried,” said the rapporteur.

According to Moraes, Bolsonaro himself admitted to talking about these “hypotheses” with the military commanders. For the minister, the meeting, which took place after the electoral defeat, proves the attempt to attract the armed forces to an intervention.

“There is no constitutional prediction for the decree of state of siege or state of defense in case of electoral defeat. Call as you want: here is a draft coup,” he said.

Moraes also highlighted documents that detail two phases of the coup planning – the so -called spyglass and operation 142. In the case of the latter, the rapporteur explained that there were already attempts to write an intervention decree, which even circulated at the table of General Walter Braga Netto advisor.

“With the terminology it wanted to give – state of exception, state of defense, state of siege. Out of constitutional hypotheses, it has only one name: coup of state,” said Moraes.

For the minister, the strategy was clear: to discredit the electoral system and justify an act of strength. “Do you lose the elections and from there you try to bring the Armed Forces to a military intervention? Why? ‘Why do I lose the elections.’ Why? ‘Because the elections were fraudulent.’ Look, who was coordinating this confusion in the country? ”Asked Moraes.

The first class of the Supreme Court, chaired by Minister Cristiano Zanin, resumed on Tuesday (9) the analysis of the complaint against the so-called “crucial core” of the alleged coup plot, appointed by the Attorney General’s Office (PGR) as responsible for articulating measures to prevent the possession of Luiz Inácio Lula da Silva (PT) after the election of 2022.

The rapporteur of the case, Minister Alexandre de Moraes, rejected all preliminary defendants argued and now presents his vote regarding the merit. The trial will have extraordinary sessions until September 12.

The eight defendants are accused of armed criminal organization, attempted violent abolition of the Democratic Rule of Law, attempted coup, damage qualified by violence and serious threat and deterioration of listed heritage. In the case of branch, part of the accusations was suspended by decision of the House of Representatives.
