Deputy Erika Hilton proposes amnesty to women convicted of abortion in Brazil

Federal Deputy Erika Hilton (PSOL-SP) presented on Saturday (8), International Women’s Day, a bill that aims to grant amnesty to all women, adolescents and health professionals accused, processed or convicted of abortion crimes in Brazil since 1940. The proposal also includes the dismissal of criminological examinations to grant the benefit.

“The rights of all women are at risk worldwide, and what we need is the courage to keep fighting for them. And never, we have to be sowed before the hatred of those who want us to be killed, ”said the deputy in publication on social network X.

Currently, abortion is allowed in the country only in cases of rape, risk to the life of pregnant women and fetal anencephaly. However, the criminalization of practice in other cases has led to the arrest of women, many of them in a situation of socioeconomic vulnerability. According to Hilton, the project seeks to correct a historical injustice and guarantee basic rights of reproductive health.

“The political amnesty of all those that have been criminalized by their ability to gestate is an important step towards repairing this violation of human rights,” says the text of the bill.

The proposal also provides that the amnesty extend to health professionals who performed abortive procedures with the consent of patients. However, the project excludes from the measure those who have performed abortions without authorization from the pregnant woman.

Other measures under discussion

In addition to amnesty, Hilton also proposes a set of measures to expand the protection of reproductive and gender rights in Brazil:

• End of the right of aggressors to request alimony: The parliamentarian proposes a change in the Maria da Penha Law to prevent perpetrators from requesting alimony from their own victims.
• Creation of a sexual and reproductive health care channel: The initiative seeks to ensure a humanized and confidential care for women who need information about their rights and reproductive health options.
• Institution of the National Day for the Fight for Reproductive Justice: The proposal seeks to establish September 28 as an official mobilization date, in reference to the Mobilization Day for the decriminalization and legalization of abortion in Latin America and the Caribbean.
• Creation of the National Day of Conneering to Transfeminicide: The project aims to establish February 15, the date of the murder of Dandara dos Santos, as a moment of reflection and mobilization to combat violence against trans women in Brazil.
