Federal Deputy Reimont (PT-RJ), chairman of the House Human Rights, Minorities and Racial Equality Commission, filed a formal request to the Public Prosecution Service to open criminal investigation against digital influencer Hytalo Santos.

The initiative occurs after complaints that youtuber would have published content that exposes sexually minors. The case gained repercussion after the Felca influencer warned of the “adultization” and possible exploitation of children and adolescents in the channel videos.

Investigation and possible measures

In the document, Reimont requests an urgent investigation of Hytalo’s conduct, focusing on the possible exploitation of images of minors, and does not rule out the assessment of pre -trial detention if continued risk to the victims is identified. The request also provides to investigate other creators of content that may adopt similar practices.

Hytalo denies the accusations. It states that part of the material was recorded with permission of those responsible and that some of the young women would be emancipated. While investigations advance, his and teenager known as Kamylinha, a frequent presence in the videos, were removed from social networks.

What the law says

In Brazil, the sexual exploitation of minors is a crime provided for in the Statute of the Child and Adolescent (ECA) and the Penal Code, covering situations such as production, dissemination or possession of nudity images or sex involving children under 18 years.
• ECA Art. 240: Produce, reproduce or direct explicit or pornographic sex scenes with children or adolescents – a penalty of 4 to 8 years in prison, as well as a fine.
• ECA Art. 241: Sell or provide children’s pornographic material – a penalty of 4 to 8 years in prison and a fine.
• Art. 241-B: Acquire, have or store children’s pornographic content-a penalty of 1 to 4 years in prison and a fine.

The emancipation of a minor does not nullify the protection provided for in law: if the person is under 18 years old, he is still considered a child or adolescent for criminal purposes, and any sexual content involving it can configure a crime.
