End of STF recess: second semester will have a coup plot and new president

The Federal Supreme Court (STF) resumes this week the judgments of the second semester with the forecast to complete the analysis of actions on the coup plot that occurred during the government of Jair Bolsonaro.

In addition, the semester will also be marked by changes in the presidency of the Court. In September, Minister Edson Fachin will succeed Luís Roberto Barroso in charge of the court.

An outcome is also planned for the Marielle Franco case, seven years after the murder of the councilwoman.

The first trial session in the plenary after the July recess will be next Wednesday (6). The Court must analyze the constitutionality of the State of Rio de Janeiro Law that authorizes the transport of emotional assistance pets on the booths operated in the state.

On Friday (1st), during the opening ceremony of the plenary’s work, the ministers made a joint defense of the Court and Minister Alexandre de Moraes after the United States government announced financial sanctions against Moraes, based on magnitisky law, a US standard that provides for the application of financial restrictions to those who are considered a violator of human rights.

In September, the first class of the Court should decide whether former President Jair Bolsonaro and seven allies will be convicted of the attempted coup in the country to reverse the result of the 2022 elections. The complaint of the Attorney General’s Office (PGR) was divided into four nuclei.

Core 1, whose defendant is Bolsonaro and his allies, is the most advanced. The PGR has already made the request for conviction of the accused.

The trial is expected to decide on the conviction or acquittal of Bolsonaro and the other defendants will take place in September.

The trial of nuclei 2, 3 and 4 is expected to take place by December this year.

CASE MARIELLE

The Marielle case can also be tried in the second half of this year.
In May, the PGR asked the Supreme to convict the accused of involvement in the murder of Councilwoman Marielle Franco and driver Anderson Gomes, which took place in 2018 in Rio de Janeiro.

At the demonstration, the Attorney’s Office defended the conviction of the Rio de Janeiro Court of Auditors (TCE-RJ) Domingos Brazão, former federal deputy Chiquinho Brazão, Domingos’s brother, former Rio de Janeiro Civil Police Chief Rivaldo Barbosa, Military Police Major Ronald Alves de Paula and former military police officer Robson Calixto, advisor to Sunday.

New president

In September, Luis Roberto Barroso will leave the presidency of the Supreme Court after fulfilling a two -year term. Minister Edson Fachin will occupy the position. Alexandre de Moraes will be the vice president. The date of the inauguration has not yet been marked.
