Ends in this 5th deadline for Bolsonaro and allies to defend themselves from the complaint of the coup
This Thursday, 6, the deadline for former President Jair Bolsonaro (PL) and the others reported by the Attorney General’s Office (PGR) in the coup inquiry send their prior defenses to the Supreme Federal Court (STF).
The prior defense is the set of arguments presented by the accused before the formal establishment of the process. It serves precisely to try to convince the ministers to reject the complaint and, therefore, end the case without the outbreak of a criminal action.
The period of 15 days began to count from the notification of the lawyers, determined by Minister Alexandre de Moraes on February 19.
The First Class of the Supreme Court will analyze the manifestations of the defenses to decide whether there are enough elements to receive the complaint from PGR. Under the internal rules of the Supreme Court, the two classes of the Court are responsible for the judgments of criminal cases.
The defenses set up task forces to analyze the case and prepare their argument. Estadão found that criminalists Paulo Amador da Cunha Bueno and Celso Vilardi, who represent former President Jair Bolsonaro, will present preliminary procedural questions and deliver the list of witnesses to be heard if the complaint is received.
In an interview with Estadão, shortly after the complaint of Attorney General Paulo Gonet arrived at the Supreme Court, the lawyers said the prosecution thesis “makes no sense.” According to the complaint, the coup plan failed because the army summit did not adhere. One of the arguments of the former president’s defense is that if he wanted to blow, Bolsonaro could have exchanged the armed forces commanders to get support from the military.

The defenses called for the suspension of counting the deadline claiming that they did not have access to all evidence of the investigation. Lawyers require, for example, the mirroring of all messages extracted from cell phones seized in the inquiry.
Criminalists Paulo Amador da Cunha Bueno and Celso Vilardi also argued that the deadline should be extended so that defenses were entitled to at least the same time used by PGR to formulate the complaint (83 days).
All requests were rejected by Alexandre de Moraes. The minister claimed that “the broad and integral access to the evidence already documented in the file is fully guaranteed to the defense of the accused.” He also pointed out that lawyers “have always had full access to the file, including removing copies and with knowledge of the orders issued.”
Alexandre de Moraes raised the confidentiality of the case after receiving the complaint. There are 18 volumes of documents that total over 3,000 pages.
Lieutenant Colonel Mauro Cid’s denunciation was also made public. The Supreme Court advertised the annexes of the award -winning collaboration agreement, both in video and written.
Moraes also shared with all 34 reported tests of confidential investigations that are related to the complaint. These are investigations involving the rise of the Brazilian Intelligence Agency (Abin), the use of the Federal Highway Police to influence the 2022 elections and the acts of January 8.
