Fachin orders non-indigenous people to leave Cachoeira Seca, in Pará

The president of the Federal Supreme Court (STF), minister Edson Fachin, ordered this Sunday (31) that the federal government draw up a plan for the expulsion of the Indigenous Land (TI) Cachoeira Seca, located in Pará.

In 2016, the territory, which belongs to the Arara people, was demarcated, but still faces problems of illegal deforestation, land grabbing, violence, in addition to the impacts caused by the construction of the Belo Monte Hydroelectric Plant.

According to the decision, the Union must present, within 90 days, a plan for the removal of non-indigenous people from the area, which must contain a schedule for the departure of invaders and to compensate bona fide occupants who are identified by the National Foundation of Indigenous Peoples (Funai).

Protection

Fachin also demanded the creation of a governance committee to guarantee protection for isolated and recently contacted indigenous people, a group of which the Arara people are part.

The plan must also assess compliance with the environmental conditions that were agreed in return during the construction of Belo Monte.

When determining the measures, Fachin said that the situation in the Cachoeira Seca Indigenous Land is an example of violation of indigenous rights.

“The measures relating to the Cachoeira Seca TI provide concreteness and material coherence so that judicial protection reaches the reality in which state omission manifests itself, preventing the seriousness experienced by the Arara people from continuing”, he stated.

The decision was motivated by an action filed by the Association of Indigenous Peoples of Brazil (Apib).
