FUX FILVA INVESTIGATION ON bribery of port entrepreneur to Renan Calheiros
Minister Luiz Fux of the Federal Supreme Court (STF) has filed an investigation that aimed Senator Renan Calheiros (MDB-AL) on suspicion of receiving bribes to meet the interests of businessman Richard Klien in the production of laws on the port sector, between 2012 and 2014. The alleged negotiation was mediated by Milton Lyra, pointed out by other investigations as MDB.
Lawyer Luis Henrique Machado, who represents the senator, states that “there was no right or indirect element of proof that would call” Renan Calheiros to the suspicions.
The inquiry opened in the wake of Operation Lava Jato was closed at the request of the Attorney General of the Republic Paulo Gonet. He argued that “new elements related to Calheiros were found, leaving the initial evidence isolated in the file.”

“Additionally, given the information currently available and resulting from the proceedings already performed, the initial evidence no longer projected the same gravity of the conduct of the investigated, empties the just cause for continuity of the parliamentarian,” said Gonet at the time.

When the Public Prosecution Service communicates the end of an investigation, it is usual that the STF ministers confirm the filing. In his decision, Fux stated that the PGR demonstration “cannot be rejected by the Federal Supreme Court.”
The filing is only in relation to Renan Calheiros. The process must be sent to the first instance of the Federal Court in Brasilia for the continuity of the investigation in relation to suspects without prerogative of forum.
