“I made a mistake”: dialogue worsens case of judge involved in the release of PCC leader
The decision that freed one of the PCC’s main names in 2020 returned to the center of debate in the Judiciary after the National Council of Justice concluded disciplinary proceedings against judge Divoncir Schereiner Maran. The magistrate was compulsorily retired.
In the report, obtained by G1messages exchanged by members of the cabinet appear that indicate internal discomfort with the measure that benefited Gerson Palermo.
Sentenced to almost 126 years in prison for trafficking, criminal association and the hijacking of a Vasp plane in 2000, Palermo left prison in April 2020 after a decision that granted him domicile. The fugitive escaped hours after his release.

The CNJ document brings together prints of conversations between advisors who worked directly on the case. In one of the messages, a server reports: “I made a ‘workaround’ and granted the request for preventive detention as Des Divoncir determined. There is a suppression of the instance and the patient only proved that he was elderly (there is no evidence of the illnesses he claimed in the HC).”
In another excerpt, the justification appears: “The guy is a drug dealer, so I ordered house arrest through electronic monitoring.”
The exchanges also record suspicions raised within the office itself. At one point, an advisor asks: “How much did it cost?” The other responds: “I don’t doubt anything, see.” The sequence continues with the identification of the person responsible for the decision and the comment: “This one already has a reputation, right”. According to the G1these conversations became part of the administrative process as they indicated the perception of irregularity in the granting of the benefit.
Palermo’s defense had maintained that the Covid-19 pandemic put the convict at risk, but the CNJ highlighted that age alone would not justify the measure given the criminal history and the leadership position attributed to the defendant in the criminal organization.
The release case also dialogues with another investigative front. Divoncir Maran is one of the targets of Operation Last Ratiowhich investigates suspicions of commercialization of judicial decisions at the Court of Justice of Mato Grosso do Sul. According to the portal, the administrative procedure also mentions financial movements considered incompatible with the income declared by the magistrate.
At the conclusion of the trial, the rapporteur of the disciplinary process, counselor João Paulo Schoucair, assessed that the judge’s conduct violated the duties of the judiciary, such as prudence and impartiality. The punishment applied was compulsory retirement — the most serious administrative sanction provided for members of the Judiciary.
