Justice denies compensation for Bolsonaro against Boulos for talking about Marielle

The Federal District Court denied on Monday, 24, an action for moral damages filed by former President Jair Bolsonaro (PL) against federal deputy Guilherme Boulos (PSOL-SP). Bolsonaro asked for compensation of $ 50,000 and public retraction for speech that would connect him to the murder of former councilor Marielle Franco. The defense of the former president can still appeal the decision.

Judge Júlio César Lérias Ribeiro, of the 6th Special Civil Court of Brasilia, understood that the facts described in the process were prescribed. They occurred between 2018 and 2021, but the deadline for compensation for moral damages is three years. The information is from Portal Metrópoles.

In the decision, the magistrate wrote that Boulos’s statements did not exceed the limits of political criticism. They would also be protected by the right to freedom of expression and parliamentary immunity of the federal deputy, as they occurred in the exercise of their mandate.

In the action, Bolsonaro presented publications from X (former Twitter) and an interview from Boulos to CNN, in which he would have made “yields” and “accusations” about an alleged participation of the former president in the murder of the then PSOL councilwoman.

In the interview, Boulos said: “What would Bolsonaro take, if he had nothing to hide regarding the murder of Marielle Franco, to put under Itamaraty telegrams that deal with the Marielle case? Who should fear! ”.

Already in posts on the social network, the deputy wrote: “Moro’s ‘anti -crime’ package reinforces dark approximations between the Bolsonaro and Duterte government of the Philippines that is accused of having led ‘death squads’, similar to militia suspected of killing Marielle Franco and having calls with Bolsonaro’s family. ”

The judge stressed that the statements were made in institutional profiles of Boulos, “used exclusively to publicize his political-parliamentary activity.” The speeches, according to the magistrate, would be related to the political debate and covered by the guarantee of parliamentary immunity.
