Justice extinguishes action in which Uber must recognize employment
Unanimously, the 13th Panel of the Regional Labor Court of the Second Region extinguished Public Civil Action in which Uber had been convicted in the first degree to recognize employment relationship of registered drivers on the platform, in addition to paying a fine of R $ 1 billion for collective moral damages.
The magistrates did not judge the merits of the action and extinguished it because they understood that the plaintiff, the Labor Prosecutor’s Office (MPT), is not the legitimate entity to defend the individual rights of workers. For the class, the employment relationship must be proved by their own individual actions of each worker.
The Public Prosecution Service may appeal to the Superior Labor Court (TST).
In a statement, Uber said that the dominant position of justice has been to point out the absence of legal requirements to characterize employment. “By extinguishing the lawsuit, the decision of the 13th class reestablish justice, because the judgment of the first degree contradicted the dominant position of jurisprudence.”
