Majority of the STF denies X’s appeal against blocking of Allan dos Santos’ account
The majority of the First Panel of the Federal Supreme Court (STF) rejected an appeal by platform
The platform requested that only content considered irregular be suspended or that the profile be taken offline for a maximum period of time.
The appeal was presented in an investigation in which the blogger is being investigated. The trial of the request was scheduled to take place between October 25th and November 5th.
Ministers Flávio Dino and Cristiano Zanin followed the vote of Moraes, rapporteur of the investigation, who argued that platform X could not appeal as it was not part of the investigation.
“It is not up to the social network provider to claim someone else’s rights in its own name, even if it is the recipient of the request for blocks determined by means of a court decision for the purposes of criminal investigation, as it is not a party to the investigative procedure”, stated the magistrate. The votes of Cármen Lúcia and Luiz Fux are still missing.
Allan dos Santos responds to two inquiries at the STF, one about digital militias and fake news. In one of the cases, there is a preventive arrest warrant and an extradition order.
Allan, who lives in the United States and works as an app driver, is considered a fugitive from Brazilian justice. Since 2021, his personal profile and blog, “Terça Livre”, have been suspended in Brazil, but he circumvents the ban by creating new profiles. In November 2022, the STF ordered the Ministry of Foreign Affairs to cancel the blogger’s passport.
