Marçal becomes a defendant for putting 32 people at risk at shipment to Pico dos Marins
The São Paulo Court accepted the complaint against coach Pablo Marçal (PRTB) for endangering the life of 32 people during an expedition to Pico dos Marins, in Piquete (SP), in January 2022. The decision was signed by Judge Rafaela Glioche, who considered the prosecutor’s accusation “adequate and sufficient” for the opening of criminal proceedings.
With the acceptance of the complaint, Marçal starts to formally respond for exposing the lives or health of third parties to direct and imminent danger – a crime provided for in article 132 of the Penal Code. The imputation was made 32 times, under continued crime (article 71). The coach will have 10 days from the subpoena to present his prior defense.

Prior to that, the prosecutor had proposed a non -criminal agreement agreement, in which Marçal would pay R $ 273,200 to terminate the process. The defense did not speak on time, and the case went to the judicial phase.

According to the complaint, the trail began on January 4, 2022 and was performed in adverse weather conditions, with heavy rain, little visibility and risk of hypothermia. The group was heading towards the summit of Pico dos Marins when the guide warned of the dangers and tried to interrupt the journey.
Also according to the MP, Marçal would have ignored the warnings and called the “coward” guide, insisting on the continuity of the climb. The prosecution reports that he encouraged the group to face the hostile nature, on the grounds that “only then would they be able to overcome and prosper in life.”
The episode generated wide repercussion at the time and placed Marçal at the center of negligence criticism. In addition to the criminal complaint, the conduct of the former candidate to the City of São Paulo was also the subject of investigations in administrative instances.
Now defendant, Marçal may present witnesses and request the production of evidence before the final judgment.
