Moraes denies a lawsuit suspension against Carla Zambelli
Minister Alexandre de Moraes of the Federal Supreme Court (STF) denied on Monday night (12) the request to suspend the case that may condemn Mrs Carla Zambelli (PL-SP) for the invasion of the electronic system of the National Council of Justice (CNJ), occurred in 2023.

Faced with the unfavorable score, Zambelli’s defense called for the suspension of the criminal action to the Supreme Court and said that the leadership of the PL also requested the House of Representatives to suspend the process based on the same argument that motivated the partial locking of the coup plot action against Deputy Alexandre Ramagem (PL-RJ).

The possibility of suspension of cases against federal deputies and senators is provided for in the Constitution. According to article 53, the House and Senate may suspend a criminal action against a parliamentarian, however, the stoppage only applies to crimes committed after diploma.
In the decision, Moraes understood that the vote of the branch case cannot be applied to the Zambelli process.
According to the minister, the accusations against Zambelli occurred before the diploma of the current term, which occurred in December 2022. According to the accusation of the Attorney General’s Office (PGR), the negotiations for the invasion of the CNJ website took place from August 2022.
“In the present hypothesis, in addition to the fact that there is no statement by the House of Representatives, none of the constitutional requirements for the application of paragraph 3 of article 53 of the Federal Constitution is present,” he said.
According to PGR’s complaint, Zambelli was the intellectual author of the invasion to issue a false arrest term against Minister Alexandre de Moraes. According to investigations, the hacking was performed by hacker Walter Delgatti, who confirmed that he had done the work at the behest of the parliamentarian.
Defenses
Carla Zambelli’s defense denies the imputation of crimes and accuses Delgatti of lying. The hacker’s lawyers reaffirmed that he acted at the behest of the deputy.
