Minister Alexandre de Moraes of the Federal Supreme Court (STF) applied a fine of R $ 8.1 million to platform X (former Twitter) for breach of a court order that determined the provision of registration data from a profile attributed to the blogger Allan dos Santos.

The request was made as part of an inquiry filed in July 2024, which investigates the involvement of the pocketist in social media crimes, including threats to STF ministers, fake dissemination and financing of undemocratic acts.

Moraes also determined that the account was blocked – which was fulfilled by X – but the company did not send the user data. In response to the Supreme Court, the social network controlled by Elon Musk claimed that “X operators do not collect registration data”, justifying the impossibility of providing the requested information.

Given the breach of the order, Moraes stipulated a fine of $ 100,000 per day until the determination. In October 2024, the minister ordered the STF Judicial Secretariat to calculate the total amount of the penalty, which reached R $ 8.1 million.

Ax Brasil appealed the decision, but Moraes denied the request and determined the immediate payment of the fine in an order signed on Wednesday (19).

Last year, the social network was blocked in Brazil for more than a month, after breaking several court orders of the Supreme Court.

Who is Allan dos Santos?

Allan dos Santos owns Tuesday Free and was one of former President Jair Bolsonaro (PL )’s main allies in the dissemination of political content on social networks.

It is investigated in multiple inquiries in the Supreme Court, including fake news, undemocratic acts and digital militias.

Since 2024, there is an extradition request from Allan dos Santos to Brazil, but the United States government – under the administration of Joe Biden – said it would not analyze the case based on the crimes of honor mentioned in the request, as they are not contemplated in the extradition treaty between the two countries and could be interpreted as a matter of freedom of expression.

Now, with the change of government in the US and the election of Donald Trump, the progress of the extradition request can be revised, depending on the new guidelines of the White House.
