Moraes maintains preventive detention of Braga Netto due to risk of escape
Minister Alexandre de Moraes, of the Federal Supreme Court (STF), maintained this Monday (3) the preventive detention of General Walter Braga Netto.
In his decision, the minister cites the conviction of the former minister in the coup plot process and the “well-founded fear of the defendant escaping”.

“In the present hypothesis, the necessary and sufficient requirements for the maintenance of preventive detention are unequivocally present, pointing, therefore, to the essential compatibility between Criminal Justice and the right to freedom” explained the minister.

Braga Netto was sentenced to 26 years in prison under an initial closed regime, but the sentence has not yet started to be served because there are pending appeals.
“The end of the trial on the merits of this Criminal Action and the well-founded fear of the defendant escaping, as has repeatedly occurred in similar situations in the convictions referring to 1/8/2023, authorize the maintenance of preventive detention to effectively guarantee the application of criminal law and, therefore, the sentencing decision”, added Moraes.
Braga Netto’s sentence was the second highest among the defendants in the “crucial core” of the coup plot – only former president Jair Bolsonaro received a higher sentence.
The appeals of the former minister and the other defendants in the case will be analyzed starting next Friday, the 7th, in the virtual plenary of the First Panel of the STF.
