Moraes reacts to Spain for Eustáquio and suspends extraction of traffic accused

The minister Alexandre de Moraesfrom the Supreme Federal Court (STF), suspended on Tuesday (15) the extradition of the citizen Bulgaro Vasil Georgiev Vasilev, arrested in Brazil at the request of Spain. The measure occurs after the Spanish government refuses to extradite a pocketist blogger Oswaldo Eustáquiorequested by Brazil.
According to Moraes, the decision of Spain violated the principle of reciprocity provided for in the Brazilian law and the extradition treaty signed between the two countries in 1990. Given this, the minister determined that the Spanish ambassador in Brazil provide clarifications within five days, proving compliance with the agreement.

“In extradite matters, it is peaceful to understand the Federal Supreme Court towards the enforceability of reciprocity by the requesting country,” Moraes said in the decision.

Influencer Oswaldo Eustáquio is investigated by the Supreme Court for encouraging undemocratic acts and had his pre -trial detention decreed at the end of 2023. He has been in Spain since the same year. The Brazilian government accuses him of promoting coup manifestations and pursuing police officers involved in the investigations.

Spanish justice denied the request for extradition on the grounds that the investigation against Eustáquio would have “political motivation.” He also considered that the acts attributed to the influencer would not constitute a crime in Spain because they were protected by freedom of expression.
In response, Moraes interrupted Vasilev’s extradition, arrested in February in Mato Grosso do Sul and accused in Spain for drug trafficking. The crime would have occurred in 2022, when he was carrying a suitcase with 52 kilos of cocaine in Barcelona. With the suspension, the accused will serve house arrest with an electronic anklet.
The decision can still be challenged in court.
