Opposition asks TCU to refine FAB Flight to bring former First Lady of Peru

The Federal Court of Audit (TCU) will investigate the legality of the use of a Brazilian Air Force (FAB) aircraft to transport the former peru-first lady, Nadine Heredia Alarcón, Brazil. The audit request was filed by Deputy Filipe Barros (PL-PR), chairman of the Foreign Relations and National Defense Commission (CREDN) of the House of Representatives.

Heredia arrived in Brazil on April 16, after being sentenced to 15 years in prison for money laundering in Peru. The Peruvian justice decision also involves her husband, former President Ollanta Humala, and points out the receipt of illicit resources from Brazilian contractor Odebrecht during the 2011 campaign.

According to the transition rule provided for in it, the end of reelection would occur only for those who were elected in 2034

Deputy Filipe Barros requests that the TCU clarifies whether there was a deviation of purpose in the use of the FAB plane, as well as eventual precedents in the transport of convicted foreigners in their countries through Brazilian military aircraft, especially in cases of political asylum. “We want to understand if there was ideological or political favoring by the government,” he said.

In addition to the audit, the commission approved two requirements with political developments. One of them calls for Foreign Minister Mauro Vieira to provide clarifications about Itamaraty’s decision to grant diplomatic asylum to the former first lady and make his transport to Brazil possible. According to Barros, “Parliament and the Brazilian people require urgent explanations of the rescue of a corrupt in Peru.”

The second request, presented by Deputy Luciano Zucco (PL-RS), consists of a motion of repudiation of the granting of the asylum. Zucco criticized what he considers a dangerous and politicized precedent by the federal government.

Remember the case

Nadine Heredia asked for asylum to Brazil still on Peruvian soil, sheltering at the Brazilian embassy in Lima shortly after the conviction. The Brazilian government recognized the request based on humanitarian and diplomatic grounds, but the operation of its removal from Peru on an official plane rekindled debates about the separation between foreign policy decisions and the use of public resources.

The trial of the Humala-Heredia couple lasted three years and was one of the biggest cases of political corruption in the recent history of Peru. Their defense argues that this is political persecution.

TCU analysis can expand pressure on the government, especially in Congress, where oppositionists should use the episode to question the criteria adopted in cases of asylum and the use of public goods in diplomatic actions.
