Parkinson’s disease: Depending on gravity and consequence, it may be entitled to sickness assistance, permanent or temporary disability retirement, BPC, FGTS withdrawal and income tax exemption.
Alzheimer’s disease: In addition to the national policy for the care of people with the disease and other dementia, other benefits can be granted, such as BPC, sick pay, disability retirement and exemption from income tax when the disease causes mental alienation (severe impairment that prevents daily activities and decision making).
Crohn’s disease and ulcerative retocolitis: Law 15.138/2025 instituted a national care policy, but care benefits can be requested if they cause serious physical limitations. A 2022 bill included conditions in the list of serious and rare SUS diseases, ensuring gratuity in the necessary medicines. The text equates the person with a rare disease to people with disabilities for all legal purposes.
Autistic Spectrum Disorder: According to Law 12.764/2012, “the person with autistic spectrum disorder is considered a disabled person for all legal purposes.” Thus, it is entitled to welfare and social security benefits such as BPC, temporary disability benefit and incumbent aid.
Other conditions that entitle the exemption in income tax are: Active tuberculosis, multiple sclerosis, blindness, leprosy, irreversible and disabling paralysis, severe cardiopathy, ankylosing spondyloarthrosis, severe nephropathy, severe hepatopathy and advanced states of Paget disease.
