Pablo Marçal is sentenced to the third ineligibility for abuse of economic power

The Electoral Court of São Paulo condemned businessman Pablo Marçal (PRTB) to his third sentence of ineligibility, expanding obstacles to his participation in political life.

The new decision, signed by Judge Antonio Maria Patiño Zorz, recognizes abuse of economic power, misuse of the media and illicit fundraising during the São Paulo City Hall in 2024.

Despite the multiple convictions, the penalties do not accumulate: Marçal remains prevented from running elections by 2032.

In the new sentence, Zorz classified as “highly reprehensible” Marçal’s actions, including attacks on opponents, such as the hint that Guilherme Boulos would be a cocaine user, as well as unfounded accusations against the Electoral Court and the candidate Tábata Amaral (PSB), to which he linked, without proof, the misuse of a party background.

The court also identified irregularities in campaign financing, noting that the entrepreneur transferred responsibility for electoral costs to voters, by disclosing links to download materials such as caps, flags and saints – demanding the inclusion of the CPF and CNPJ in impressions.

In addition, Marçal used strategies such as raffles of R $ 200, caps and campaigns with influencers to boost his candidacy on social networks, even after his profiles suspended. “I find the severity of the conduct practiced by the defendant Pablo Marçal, although it has not been elected or reached the second round,” said the judge.

Previous convictions

This is Marçal’s third electoral condemnation due to the 2024 election. In February, the same judge had already declared his ineligibility for offering political support in exchange for donations to candidates for councilor, through videos published on the Internet. The suggested value was $ 5,000.

In April, the second sentence recognized the illegal boost of content on social networks, as well as irregular spending on the campaign. The judge determined a fine of R $ 420 thousand, based on an electoral judicial investigation action (AIJE) filed by the PSB of Tábata Amaral.

At the time, the decision stressed that the videos released by Marçal, with prizes and contests for cuts of their lines, reached millions of followers on platforms such as Tiktok, Instagram and YouTube, configuring misuse of the media on a large scale.
