PGR defends the progression of Daniel Silveira, Bolsonaro’s ally, to the semi-open regime
The Attorney General’s Office (PGR) defended, this Wednesday (2), the progression of regime for the former federal deputy Daniel Silveira (no party-RJ)who is imprisoned in Rio de Janeiro (RJ).
The final decision will be up to the minister Alexandre de Moraesof the Federal Supreme Court (STF).
The PGR spoke out after the Rio de Janeiro Penitentiary Administration Secretariat (Seap) presented reports that authorized the progression of the regime.
Daniel Silveira was arrested in early February 2023, one day after the end of his term in the Chamber. He even benefited from a pardon given by the then president Jair Bolsonaro (PL)but the measure was annulled last year by the Supreme Court.
In 2022, Silveira was sentenced to 8 years and 9 months in prison, initially in a closed regime, for the crime of threatening the Democratic Rule of Law. The then parliamentarian recorded videos in which he threatened and offended Supreme Court ministers.
According to the Court, the former deputy, who was one of Bolsonaro’s main allies, encouraged anti-democratic acts in the country. Silveira also responds for attempted coercion during the process.
“Once the steps have been taken and compliance with the subjective requirements has been confirmed, it is necessary to grant the benefit”, noted the deputy attorney general of the Republic, Hindemburgo Chateaubriand Filho, in his opinion.
After the delivery of professional reports from psychologists and psychiatrists, in addition to social services, the Technical Classification Committee, established by Seap, expressed its favor to Silveira’s defense request.
According to the psychological report presented by the former deputy’s defenders, Silveira “recognizes that he has adopted an offensive stance and that he should not inflame third parties through his own speech as a public figure”.
The document also says that the former parliamentarian “did not show signs of aggression” and that “there appear to be no reports of this type of behavior in the prison environment”.
In July this year, Alexandre de Moraes denied a request from Silveira’s lawyers for the former deputy to progress to the semi-open regime.
