Rapporteur anticipates end of reelection to 2030 and CCJ advances voting

The Senate Constitution and Justice Commission (CCJ) postponed on Wednesday (7), after a request for a view, the vote on the Proposal of Amendment to the Constitution (PEC) that extinguishes reelection to the positions of President of the Republic, Mayor and Governor. The theme should be resumed next week.

The rapporteur of the article, Senator Marcelo Castro (MDB-PI), presented a new opinion by shortening the transition rule so that the end of reelection to governors and president will be valid in 2030, not 2034, as the previous text predicted.

The change occurred after senators criticized at the last CCJ session that the transition was very long.

PEC 12 of 2022 still increases the term of office of the executive’s heads, deputies and councilors for five years and senators for ten years. In addition, the proposal unifies the elections in Brazil to 2034, when Brazilians would elect all positions at once. Currently, voters go to the polls every two years.

The rapporteur Marcelo Castro justified that Brazil never had reelection to executive positions before 1997, when Parliament approved the reelection, giving former President Fernando Henrique Cardoso the possibility of running a new mandate of president.

“The advent of reelection has brought many distortions in political practice. In the past election, 83% of the mayors who have disputed reelection in Brazil have been able to reelect. This is a very clear fact that there is no parity of arms when a election with the mayor, or governor, or president of the Republic in power will be disputed,” Castro argued.

Criticism

Although the end of reelection has broad support from the CCJ, the increase in senator mandates to ten years has been the subject of criticism. Senator Eliziane Gama (PSD-MA) has asked the rapporteur to maintain four years for deputies and eight for senators.

“You leave an eight -year term, which is already a long time, for a 10 -year term? There is no country that has a decade of office for senator. And increasing the five -year office of deputy is not good either. In the American case, we have two years of office for deputies. There is a frequent presence of the electoral process,” said the parliamentarian.

For the executive, the parliamentarian defended a longer time, six years in office. “No government can do a structuring work, in a state or municipality, in four years, or even in five years,” he added.

Transition

According to the rapporteur’s opinion, the reelection would be worth in 2026. In 2028, the mayors would have a six -year -old extended term, without reelection, so that in 2034 all elections coincide in a single election.

Already governors and president could reelect themselves in 2026. With this, in 2030 would be the first elections without possibility of reelection for governors and president of the Republic.
