Senate CCJ analyzes PEC that prohibits reelection for president, governor and mayor

The Senate Constitution and Justice Commission (CCJ) should vote on Wednesday, 14, the proposal to amend the Constitution that extinguishes reelection to the positions of President of the Republic, governors and mayors. The text also proposes the increase in mandate time: five years for executive heads and ten years for senators.

The meeting to discuss PEC 12/2022, at 9am, will have five items on the agenda. According to the author of the proposal, Senator Jorge Kajuru (Somos-GO), the intention is to ensure that candidates for positions of the Executive Power have “a greater opportunity to compete in more egalitarian conditions, without the advantage of current occupants of the position”.

The text also mentions that, for society, “the proposal can promote political renewal, allowing the emergence of new leaders and ideas, as well as providing a longer period for the implementation of government programs.”

If approved, the proposal provides that current executive members will finish their current mandates and, if they are in the first term, may apply for reelection one last time. For the electoral system, change may require adjustments in calendars and electoral processes.

Marcelo Castro’s proposal (MDB-PI) also provides for the unification of elections for all positions in the country every five years-both in the executive and in the legislature. According to the rapporteur, the measure should generate savings of public resources and more predictability.

The vote of PEC 12/2022 was scheduled for last Wednesday, 7, but was postponed after a request for view of Senator Eliziane Gama (PSD-MA).

In the new meeting, in addition to this proposal, the CCJ will also discuss Bill (PL) 5,490/2023, which ends the bail for the crimes related to the practice of pedophilia, PL 2,326/2022, which grants firearm to members of the National Foundation of Indigenous Peoples (Funai) and PL 3,786/2021, which typifies the crimes of body injury and crimes and Homicide related to the traffic.
