STF discusses today’s reimbursement of undue discounts for the benefits of the INSS

Supreme Federal Court (STF) holds today (24) conciliation hearing on reimbursement of fraudulent discounted values ​​of retirees and pensioners of the National Institute of Social Security (INSS). The meeting is a law firm of the Union (AGU), which also calls for authorization to open an extraordinary credit in the public budget, which, if approved, will be intended for payment and will be left out of the federal spending ceiling in the years 2025 and 2026.

The hearing was called by the STF Minister Dias Toffoli. The INSS and AGU is expected to present a calendar project of returns. They were also invited to participate in the meeting, representatives of the Federal Public Defender’s Office (DPU) and the Federal Prosecutor’s Office (MPF).

During a live virtual broadcast, held last Wednesday, the Union General, Jorge Messias said that the announcement of the payment dates depends on the approval of the Court:

“From the moment we get a final statement of the Supreme Court, we will be able to present, by the INSS, a payment calendar.”

The AGU also asked the Supreme Court suspension of the ongoing proceedings dealing with the liability of the Union and the INSS for illegal discounts, as well as the decisions already made on the subject. The goal is to avoid mass judicialization of cases.

Dias Toffoli, has already complied with one of AGU’s requests: to suspend the prescription period, which corresponds to the legal time that the victims would have to file lawsuits requesting compensation.

NUMBER OF CONTESTATIONS

Until last Friday (20), retirees and pensioners have recorded 3.5 million demonstrations of non-recognition of associative discounts. The Federal Police and CGU estimates that it can reach 4.1 million contestations

“Today, the Union’s General Advocacy has already achieved, with the Federal Court, a blockade of R $ 2.8 billion in the assets of these fraudsters. This would be enough to be able to pay all 3.2 million requested. This is the idea, that we anticipate, that we pay, not our retired and pensioner in the loss,” said Gilberto Waller Jr., president of the INSS.

VALUE RETURN PLAN

Waller also said he plans to pay lots every 15 days for the victims of undue discounts.

“The idea is that this payment will occur later this year, in a unique and very simplified portion, to retirees and pensioners,” said Messias. “In a single month, two lots of beneficiaries will be paid.”

Cases where there is no response or proof of regularity. In such cases, the federal government will reimburse the retiree and pensioner in a schedule to be informed soon.

Union’s general lawyer recalled, however, that AGU is already acting in court to recover these resources.

“It is important for society to know that we go after every penny diverted. We will not accept that the Brazilian taxpayer pays this account,” said Messiah.

How to contest the improper discounts

The beneficiary must record the contestation by the application (available for Android and iOS) and my INSS website or in person at the post office.

After the request, the entity responsible for the discount will be notified to present proof of authorization. If there is no response within 15 business days, the association will have five more days to return the value. If the reimbursement does not occur, the federal government will guarantee the return directly to the insured.
