STF has four votes to condemn Zambelli to 10 years in prison

The first class of the Supreme Federal Court (STF) has already formed a majority to condemn federal deputy Carla Zambelli (PL-SP) to 10 years in prison and the loss of office for involvement in the invasion of the National Council of Justice (CNJ) system in 2023.

The trial, which takes place in a virtual plenary, already has four votes favorable to the conviction: rapporteur Alexandre de Moraes, Cristiano Zanin, Flávio Dino and Minister Cármen Lúcia, who highlighted the gravity and the premeditation of the crime. Only the vote of Minister Luiz Fux, who has until Friday (16) to speak out.

According to the complaint of the Attorney General’s Office, Zambelli would have coordinated the action performed by hacker Walter Delgatti Neto, also a defendant in the case. Among the acts performed, false documents were issued, including an arrest warrant forged against Moraes himself, with the ironic phrase: “The arrest warrant is issued to the detriment of myself, Alexandre de Moraes. A blockade of R $ 22.9 million in assets of the minister was also simulated.

The penalty proposed by Moraes to Delgatti is 8 years and 3 months. The punishments should only be fulfilled after the final judgment. Cármen Lúcia rejected the defense’s allegations about suspicion of the rapporteur and considered proven the materiality and authorship of the crimes of invasion of the computerized system and ideological falsehood.

What the defense says

In a press release, Carla Zambelli’s defense challenged a virtual trial to condemn the deputy. Lawyers also considered “absolutely unfair” that the parliamentarian be condemned “without irrefutable evidence.”

“Absolutely unfair that the deputy was tried and condemned without irrefutable and undoubted evidence, especially for facts that he was unaware of, such as the false permits that Mitoman Walter (Delgatti) made to his cousin and third people. It should be not ceased to believe in justice and one of the ministers is expected to request all the arguments released by the defense and, in the future, to modify, and to examine all the arguments. The course suggested by the rapporteur, ”said the lawyers.

Elections

Carla Zambelli responds to another criminal case in the STF. In August 2023, Zambelli turned back to the Supreme Court for the episode in which she drew a firearm and chased journalist Luan Araújo on the eve of the second round of the 2022 elections.

The persecution began after Zambelli and Luan exchanged provocations during a political act in the Jardins neighborhood of São Paulo.

To date, the Supreme Court has registered a score of 5 votes to 0 to condemn the parliamentarian to 5 years and 3 months in prison in semi -open regime. However, a request for a view of Minister Nunes Marques postponed the conclusion of the trial.
