STF reaches a majority to keep Moraes, Zanin and Dino in the trial of Bolsonaro
The Federal Supreme Court (STF) reached the majority of votes to reject the appeals presented by former President Jair Bolsonaro (PL) and generals Walter Braga Netto and Mário Fernandes, who tried to exclude ministers Alexandre de Moraes, Flávio Dino and Cristiano Zanin from the judgment of the coup complaint.
So far, ministers Luis Roberto Barroso, Alexandre de Moraes, Gilmar Mendes, Cristiano Zanin, Dias Toffoli and Edson Fachin voted against requests for impediment.
In his vote, Barroso reiterated that the defenses did not present concrete evidence to justify the removal of the ministers. For the president of the Supreme Court, there was no “concrete demonstration of bias”.

“Generic and unaccompanied allegations of concrete evidence of the judge’s biases are not led to the characterization of the alleged impediment,” wrote Barroso.
The funds are being analyzed in an extraordinary session in the Virtual Plenary of the Supreme Court, with a vote scheduled to end at 11:59 pm on Thursday (20). The decision was urgently based, as the judgment of the complaint against Bolsonaro and six others involved in the alleged coup plan is scheduled for March 25, in the first class of the court.
Judgment appeals include:
- Mário Fernandes requested the suspension of Minister Flávio Dino, claiming that he was Minister of Justice during the events of 8 January.
- Bolsonaro alleged the suspicion of Flávio Dino based on a criminal complaint filed against the former president for slander, injury and defamation, when Dino was governor of Maranhão.
- Bolsonaro also requested the impediment of Cristiano Zanin, stating that when the minister was a lawyer, he subscribed a criminal news against Bolsonaro for attacks on the institutions.
- Braga Netto questioned Alexandre de Moraes’s impartiality, claiming that the minister could not report the process due to the complaint involving an alleged operation to execute it during the coup-the plan green and yellow and the 2022 World Cup.
