STF rejects preliminary and advances to judge receipt of the complaint about coup
The First Class of the Supreme Federal Court (STF) rejected on Tuesday (22) all the preliminary questions presented by the defenses of the six accused of joining the “Management Center” of the coup attempt after the 2022 elections.
With this, the ministers advanced to the analysis of the merits of the complaint presented by the Attorney General’s Office (PGR), which can transform those investigated into defendants later this afternoon.

The so -called preliminary questions are procedural resources used to contest the conduct of the case prior to the analysis of the contents of the accusations. Among the rejected claims were allegations that the trial should take place in other judicial instances or in the plenary of the Supreme Court, as well as requests for suspicion against ministers such as Alexandre de Moraes, Cristiano Zanin and Flávio Dino, as well as against the Attorney General, Paulo Gonet.

Other questions included criticism of Mauro Cid’s award -winning denunciation, defense curtailment allegations, as well as the contestation of the complaint itself, considered by the defenses as inept and without just cause. All these points were unanimously refuted by the ministers of the First Class.
The six accused are:

- Filipe Martinsformer special advisor to international matters of the Presidency;
- MARÍLIA FERREIRA DE ALENCARformer intelligence director of the Ministry of Justice;
- Mário Fernandesreserve general and former number two of the General Secretariat of the Presidency;
- Silvinei Vasquesformer director general of the Federal Highway Police (PRF).
According to PGR, the members of the so -called “core 2” occupied strategic positions in the public machine and were responsible for operationalizing the coup plan.
Among the actions attributed to the group are the use of the PRF to restrict the right to vote of voters in the Northeast-the region of greater support to Luiz Inacio Lula da Silva (PT)-the elaboration of a draft unconstitutional decree to support the result of the elections and also the conception of a plan to murder authorities, such as President Lula, Vice President Geraldo Alckmin and the Minister of STF of Moraes.
With the rejection of the questions, the ministers will deliberate on the formal opening of criminal action. If the complaint is accepted, the six accused will become defendants in the Supreme Court for the crimes of:
- attempted coup d’état,
- violent abolition of the democratic rule of law,
- criminal organization,
- qualified damage,
- and deterioration of listed heritage.
The session was resumed early in the afternoon and can be closed later this Tuesday with the receipt or not of the complaint.
