STF unanimously maintains Vorcaro’s arrest, but Gilmar makes reservations in vote

By 4 votes to 0, the Second Panel of the Federal Supreme Court (STF) decided this Friday (20) to keep banker Daniel Vorcaro, owner of Banco Master, in prison.

The collegiate concluded the virtual trial of the case and endorsed the decision of Minister André Mendonça, who, on the 4th of this month, ordered the arrest of the banker and two of his allies.

Vorcaro’s brother-in-law, Fabiano Zettel, accused of being a financial operator, and retired Federal Police (PF) clerk Marilson Roseno da Silva, who allegedly helped in accessing confidential information from the investigations, will also remain in prison.

The virtual trial began on Friday (13), when a majority of 3 votes to 0 was formed to maintain the prison. In addition to Mendonça, ministers Luiz Fux and Nunes Marques voted in this regard.

The last vote was given today by minister Gilmar Mendes, who followed the majority, but made several reservations in the vote.

Dias Toffoli, who also belongs to the collegiate, declared himself a suspect and did not participate in the trial.

Toffoli is one of the partners of the Tayayá resort, located in Paraná. The project was purchased by an investment fund that is linked to Master and investigated by the PF.

Denunciation

Last week, after the Supreme Court formed a majority vote, Vorcaro decided to change lawyers.

The panel of lawyer Pierpaolo Bottini, a critic of whistleblowing, left the process and was replaced by José Luis Oliveira, one of the best-known criminal lawyers in the country.

The move signaled Vorcaro’s intention to sign a plea agreement.

Yesterday, the banker was transferred from the Federal Penitentiary in Brasília to the Federal Police superintendency prison.

Changing the place of arrest was the first step in negotiations to conclude the award-winning collaboration with the delegates responsible for the investigation and the Attorney General’s Office (PGR).
