Toffoli prevents INSS CPI from analyzing data and messages from Vorcaro

Minister Dias Toffoli, of the Federal Supreme Court (STF), withdrew the INSS CPI’s access to the material on the breach of banking, tax and telematic secrecy of the owner of Banco Master, Daniel Vorcaro. The decision was sent to the Senate’s Attorney General’s Office this Friday.

According to the decision, on a preliminary basis, only the president of the Senate, Davi Alcolumbre (União-AP), can access the information, which includes financial data and messages, for example. Alcolumbre is not a member of the CPI.

Vorcaro’s data has already been removed from the system, according to the collegiate’s rapporteur, deputy Alfredo Gaspar (União-AL).

The material with Vorcaro’s breach of confidentiality began arriving at the CPI last week. The Central Bank (BC), the authority responsible for customers’ banking secrecy, was also notified of the order to prevent banks from continuing to send data to the CPI system, where the information is stored for restricted access. The decision was also passed on to the Federal Revenue.

Toffoli’s office confirmed the decision and explained that, initially, Vorcaro’s lawyers asked for the breaches of confidentiality to be annulled. The minister refused, but determined that the documents arising from the measures must be sent directly to the Senate presidency until further deliberation by the STF. When contacted, Alcolumbre did not respond.

Vorcaro is a key player in the investigations into an alleged R$12.2 billion fraud scheme in the sale of credits to Banco de Brasília (BRB). He was detained for nine days and was released using an electronic ankle bracelet.

Trip to Lima

Last week, the CPI approved the breaking of Vorcaro’s banking, tax and telematic secrecy. On the occasion, the commission’s rapporteur, deputy Alfredo Gaspar (União-AL), stated that the banker would have to clarify Master operations involving credit granted to retirees and pensioners, in addition to investments of civil servants’ pension funds in Master, which is in the process of being liquidated by the BC.

At the beginning of this month, Toffoli decided to keep the action filed by Vorcaro against the operation confidential and ordered the case to be processed in the STF.
